Privacy Policy, Terms of Use & Copyright

This is a binding legal agreement. By accessing this website, creating an account, enrolling, or purchasing any course or product from Texas Massage Academy, you acknowledge that you have read, understood, and agree to be bound by every section below. If you do not agree, do not use this site or purchase from us.

Acceptance & Eligibility

These Terms of Use, this Privacy Policy, and all related policies (collectively, the “Terms”) form a legally binding agreement between you and Texas Massage Academy (“TMA,” “we,” “us,” or “our”).

By accessing or using texasmassageacademy.com and any subdomain, learning portal, or service we operate (the “Site”), or by enrolling in or purchasing any program, course, or product, you represent that you have read and agree to these Terms and to all applicable laws.

You must be at least 18 years old to make a purchase or form a binding contract on your own behalf. Minors may use the Site and enroll in eligible online coursework only with the involvement and consent of a parent or legal guardian, who accepts these Terms on the minor's behalf. Certain credentials and the state licensing examination carry separate age and education requirements described in our official catalog.

Who We Are

Texas Massage Academy is a massage therapy school approved and regulated by the Texas Department of Licensing and Regulation (TDLR), license MS1040, located at 400 Center Avenue, Brownwood, Texas 76801. Questions about these Terms? See Section 16, Contact.

Privacy Policy

In plain EnglishWe collect what we need to teach you, enroll you, and process your payments, nothing shadier. We never sell your personal information. Payments are handled by a secure processor, and we don't store your full card number.

Information you give us

When you contact us, request information, create an account, enroll, or buy a course, we may collect your name, email address, phone number, mailing address, date of birth, education history, and information related to your enrollment and coursework. When you purchase, our payment processor collects your payment details to complete the transaction (see “Payments” below).

Information collected automatically

Like most websites, we automatically receive certain technical data when you visit, including your IP address, browser and device type, pages viewed, referring pages, and timestamps. We use cookies and similar technologies for site functionality, analytics, and advertising measurement.

Cookies & tracking technologies

We use cookies and pixel/tag technologies, including the Meta (Facebook) Pixel and analytics tools, to understand how the Site is used and to measure and improve our advertising. These third parties may set their own cookies subject to their privacy policies. You can control or disable cookies through your browser settings and opt out of interest-based advertising through your device or ad-platform settings; some features may not work correctly if cookies are disabled.

How we use your information

  • To respond to your inquiries and provide the information, programs, or products you request;
  • To process enrollment, deliver coursework, administer accounts, and issue records or credentials;
  • To process payments and prevent fraud;
  • To communicate with you about your account, classes, schedules, and important updates;
  • To improve the Site, our courses, and our marketing; and
  • To comply with legal, regulatory (including TDLR), and recordkeeping obligations.

How we share information

We do not sell your personal information. We share it only with: (a) trusted service providers who operate the Site, our learning platform, and communications on our behalf; (b) our payment processors, PayPal and Stripe, to process transactions; (c) regulators such as TDLR, or other authorities, where required by law; and (d) professional advisors, or a successor entity in connection with a business transfer. Service providers are permitted to use your information only to perform services for us.

Data retention & security

We retain personal information only as long as necessary for the purposes described here or as required by law and TDLR recordkeeping rules, after which it is deleted or de-identified. We use reasonable administrative, technical, and physical safeguards to protect your information. No method of transmission or storage is 100% secure, and we cannot guarantee absolute security.

Your privacy choices & rights

You may request to access, correct, or delete the personal information we hold about you, and you may opt out of marketing emails at any time using the unsubscribe link or by contacting us. Depending on where you live, you may have additional rights under state privacy laws (for example, the California Consumer Privacy Act). To exercise any right, contact us using Section 16; we will respond as required by applicable law.

Children's privacy

We do not knowingly collect personal information from children under 13 without verifiable parental consent. High school and minor students may enroll in eligible programs only with parent or guardian involvement as described in Section 1. If you believe a child has provided us information without consent, contact us and we will delete it.

Communications

By providing your contact details you consent to receive communications from us about your inquiry, account, or enrollment. Our published phone number is for calls; we do not use it for text-message marketing. You can opt out of promotional email at any time; we may still send you essential account, enrollment, or transactional messages.

Intellectual Property & Copyright

Everything on this Site and in our programs is ours. Read this section carefully, we protect it aggressively.

Ownership

All content, materials, and works made available by TMA, including but not limited to our curriculum, course outlines, lesson plans, written materials, study guides, handouts, examinations and answer keys, videos, audio, images, illustrations, characters and mascots, graphics, logos, the look, feel, design, and code of this Site, and all materials within our learning portal (collectively, the “Content”), are owned by Texas Massage Academy or its licensors and are protected by United States and international copyright, trademark, and trade-secret law. © 2011–2026 Texas Massage Academy. All rights reserved. The TMA name, logo, and MS1040-affiliated branding are our trademarks and may not be used without our prior written permission.

Our curriculum is a confidential trade secret

Our course design, sequencing, instructional methods, assessments, and supporting materials are proprietary and confidential trade secrets that derive value from not being known to or usable by competitors. Access to them does not transfer any ownership and is conditioned on the restrictions in these Terms.

Your limited license

Subject to your compliance with these Terms and payment of all applicable fees, we grant you a limited, personal, non-exclusive, non-transferable, non-sublicensable, and revocable license to access and use the Content you are enrolled in or have purchased solely for your own personal education. This license grants you no ownership and ends automatically if you violate these Terms.

What you may not do

Except as expressly permitted in writing by TMA, you may not, directly or through anyone else:

  • copy, reproduce, photograph, or duplicate the Content;
  • screen-record, screenshot, download, or capture course videos or materials;
  • republish, post, distribute, or transmit the Content;
  • sell, resell, license, rent, or share the Content or your account access;
  • use the Content to teach, train, or operate any class, course, or program;
  • use the Content to start, build, supply, or run a competing school or course;
  • modify, adapt, translate, or create derivative works;
  • remove or alter any copyright, trademark, or proprietary notice;
  • scrape, crawl, data-mine, or harvest the Content by any automated means;
  • use the Content to train, fine-tune, or build any artificial-intelligence or machine-learning system;
  • reverse engineer or attempt to extract the source of the Site or learning portal.

Copying our materials, in whole or in part, and especially reproducing our curriculum or written content for use at another school or business, is willful copyright infringement and misappropriation of trade secrets. It is not a gray area, and we treat it as the serious theft that it is.

Acceptable Use & Anti-Piracy

Account security & one user per login

Accounts and logins are personal to you. You are responsible for keeping your credentials confidential and for all activity under your account. Sharing, selling, or distributing login credentials is prohibited and is grounds for immediate termination without refund, in addition to any other remedies.

Prohibited conduct

  • circumventing, disabling, or interfering with any security, access-control, or usage-limiting feature;
  • accessing the Site or portal by automated means (bots, scrapers, crawlers) or bulk-downloading Content;
  • introducing malware, attempting to gain unauthorized access, or disrupting the Site or other users;
  • using the Site or Content for any unlawful purpose or in violation of these Terms.

Monitoring & protection

To protect our Content and students, we may watermark, fingerprint, tag, or otherwise mark our materials and monitor access and usage, including identifying the account associated with any copy. Distributed or leaked materials can be traced back to the account they came from. We reserve the right to suspend or terminate access for suspected violations and to pursue every remedy available to us.

Enforcement & Remedies

We actively enforce our rights. If you infringe our copyrights, misuse our trademarks, or misappropriate our trade secrets or Content, you may be liable for, and we may pursue, any combination of the following:

  • Statutory damages of up to $150,000 per work for willful copyright infringement, plus actual damages and any profits attributable to the infringement (17 U.S.C. § 504);
  • Injunctive relief, court orders requiring the infringing use to stop and infringing copies to be destroyed;
  • Recovery of our attorneys' fees and costs of enforcement (17 U.S.C. § 505 and as provided by contract and law);
  • Damages and remedies under the Defend Trade Secrets Act and the Texas Uniform Trade Secrets Act; and
  • Referral to appropriate authorities for civil and, where applicable, criminal action.

Liquidated damages. Because the harm from unauthorized copying, distribution, resale, publication, or competitive use of our Content is real but difficult to quantify, you agree that for each work, lesson, handout, form, template, video, document, policy, procedure, or other material used in violation of these Terms, you will pay TMA liquidated damages of $2,500 per work or material, or $10,000 for any use of our Content in connection with a competing school, training program, course, website, or educational product, whichever is greater. These amounts are intended as a reasonable estimate of harm and not as a penalty, in addition to injunctive relief and our attorneys' fees. This does not limit our right to elect actual damages or statutory damages instead.

Our failure to enforce any provision is not a waiver of our right to enforce it later.

DMCA / Copyright Complaints

We respect intellectual property and expect others to do the same.

If your work appears on our Site

If you believe content on our Site infringes your copyright, send a written notice under the Digital Millennium Copyright Act to our designated agent (below) including: your contact information; identification of the copyrighted work; identification and location (URL) of the allegedly infringing material; a statement of good-faith belief that the use is not authorized; a statement, under penalty of perjury, that your notice is accurate and that you are the owner or authorized to act; and your physical or electronic signature.

If we find our work on someone else's site or school

We issue DMCA takedown notices and pursue all available remedies against unauthorized copies of our Content, including notices to host providers, platforms, and search engines.

Course Purchases & Payments

In plain EnglishWhen you buy a course online, you're buying licensed access for yourself, not ownership of the materials. Payments run through a secure processor; we don't keep your full card number.

When you purchase a course, program, or product through the Site or our learning portal, you agree to pay all listed prices and applicable taxes and fees. Prices and offerings may change at any time, but changes do not affect orders already completed.

Payments are processed by our third-party payment processors, PayPal and Stripe, and are subject to those processors' terms and privacy policies. We do not store your full payment-card number. By submitting an order, you authorize the charge to your selected payment method.

All purchases grant a limited license to access Content for your personal education as described in Section 4; access is licensed, not sold, and ownership of the Content never transfers to you. We may suspend or terminate access, without refund, for violation of these Terms, including credential sharing, piracy, or unauthorized use under Section 5.

Refunds & Cancellation

In plain EnglishAs a TDLR-approved school, our refund and cancellation rules are set by state regulation and spelled out in our official catalog. Those rules control.

Tuition refunds, cancellation, and withdrawal for our regulated programs are governed by the rules of the Texas Department of Licensing and Regulation (TDLR) and the refund and cancellation policy set forth in our official School Catalog. In the event of any conflict, the catalog and applicable TDLR rules control for tuition and enrollment.

For any non-tuition digital products or course purchases not covered by the catalog, and except where a non-refundable purchase is stated at checkout or a different right is required by law, refund requests should be directed to us using Section 16. Because digital course materials are delivered immediately and cannot be returned, access that has been started or downloaded may be non-refundable.

Disclaimers

The Site and Content are provided on an “as is” and “as available” basis without warranties of any kind, whether express or implied, including any implied warranties of merchantability, fitness for a particular purpose, and non-infringement, to the fullest extent permitted by law.

Our educational materials are for instruction only and are not medical advice. We make no guarantee regarding any particular outcome, including completion, passing the state licensing examination, licensure, certification, income, or employment, which depend on your own effort and factors outside our control. We do not warrant that the Site will be uninterrupted, secure, or error-free.

Limitation of Liability

To the fullest extent permitted by law, Texas Massage Academy and its owners, instructors, employees, and agents will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, data, or goodwill, arising out of or relating to your use of (or inability to use) the Site or Content. Our total liability for any claim relating to the Site or a purchase will not exceed the amount you paid to us for the product or service giving rise to the claim in the twelve (12) months before the claim arose.

Indemnification

You agree to defend, indemnify, and hold harmless Texas Massage Academy and its owners, instructors, employees, and agents from and against any claims, damages, losses, liabilities, and expenses (including reasonable attorneys' fees) arising out of or related to your use of the Site or Content, your violation of these Terms, or your infringement or misappropriation of any intellectual property or other right.

Governing Law & Disputes

These Terms and any dispute arising out of or relating to them or the Site are governed by the laws of the State of Texas, without regard to its conflict-of-laws rules. You agree that the exclusive jurisdiction and venue for any dispute will be the state and federal courts located in Brown County, Texas, and you consent to personal jurisdiction there.

In any action to enforce these Terms, the prevailing party is entitled to recover its reasonable attorneys' fees and costs. To the extent permitted by law, each party waives any right to a jury trial, and any claim must be brought within one (1) year after it arises. Nothing in this section limits our right to seek injunctive relief in any court of competent jurisdiction to protect our intellectual property.

Changes to These Terms

We may update these Terms at any time. Changes are effective when posted, and we will update the “Last Updated” date above. Your continued use of the Site or any purchase after changes are posted means you accept the updated Terms. We encourage you to review this page periodically.
